We filed civil suit and the first trial judge(Judge Jon Spahr, Licking County) granted summary judgment in less than 48 hours after receiving our documents, almost as if he already made up his mind. Didn't give a reason why we didn't meet our proof, just granted it. What power that is for one judge to have. Appellate court upheld that trial judge with an opinion that they made up and misquoting a deposition in order to justify this ruling. Ohio Supreme court refused to review this. Then the VSSR for Workman's Comp. denied the family's request and even after submitting the testimony of a Kokosing employee's statement that he knowingly allowed erroneous and untrue information to be entered and sworn too, they still refuse to re-open the case. I want to know where to go for a grassroots movement or how to start one. On so many levels these deaths are not right and from the numbers of people losing loved ones and not getting ANY satisfaction from employers who get slapped on the hand, from the judicial system who turns a blind eye in order to protect these businesses. No one is looking out for the individual. OSHA was created for the worker. What they've done is create a great big rule book that employers hate, don't follow, then when they get caught, OSHA slaps them on the wrist and says don't do this..OSHA fines never go to the families, they go somewhere, but the families do not receive anything, unless they sue (Ohio has intentional tort and 1 judge has the power to say if there is a case or not, as in our case) Oh yeah, if they do get Workman's Compensation, they have to hire attorneys, even if OSHA cited the company for infractions, you can't use that in the civil suit. The family's of victims that are hurt/died on the jobs are always, I mean always, put in a much deeper, financial and emotional strain, cause the burden of proof falls on them and we all know how the company's start "damage control" as soon as the accident happens.

On 11/09/2005 our son got killed by getting hit in the head with a 800 lb garage beam. This is a safety issue. The biggest concern is safety and to enforce a drug free work environment. He had a high level of THC. Lets enforce a drug free work place to safety for all workers. Below is a list of information one can access on line.. The most recent report from www.osha.gov website Description of Accident: Workers were installing a steel garage header that was held in place by the forks of a forklift. The forklift operator retracted the forks and exited the forklift. While standing under the header, the header fell and struck the employee in the head No citations issued. No standards violated. 2005 MNOSHA Fatality and Serious Injury Investigation Summary Log (updated through March 31, 2006)
