Education and Activism Opportunity!!

H and S community in Denver on Nov. 4-7

USMWF was able to bring 13 family members to attend the National COSH meeting the Health and Safety Summit and meet with an amazing team at the Denver OSHA office, Region 8 . The Denver visit was a very unique because USMWF members have never meet with a Labor Liaison or a Solicitor of Labor.  USMWF has enjoyed many events and meetings with OSHA offices but felt this particular visit was a good start for new relationships and very informative.

Steven Michael Lillicrap, 21

Steven Michael Lillicrap, 21 ~ 9/2/1987 - 2/3/2009 ~ Sent in by mother, Diane Lillicrap ~ Killed while disassembling a 100 ton crain while as an apprentice Operating Engineer for a construction company in St. Louis, MO


Steven Michael Lillicrap, 21 was killed on the job on 02/03/09 while working at Ben Hur Construction in St Louis, MO. He died from crushing injuries while disassembling a crane. Federal OSHA investigated the incident and assessed a $84,000. The company contested and all the violations were vacated.

Alan Paul Lowrie, 17

Alan Paul Lowrie, 17 ~ 11/2/1986 - 10/24/2004 ~ Sent in by family friend, Lee Joslyn ~ Murdered by a coworker and a disgruntled former employee in a planned robbery and intentional double homicide. Found in the Arby's cooler/freezer an hour or so after closing time; shot multiple times.


Alan Paul Lowrie, 17 was killed on the job on 10/24/04 while working at Arby's in West Milwaukee, WI. He was murdered by a disgruntled employee. OSHA was unable to provide information on this case. OSHA does not investigate homisides.

Walter J. Lubanty Jr, 43

Walter J. Lubanty Jr, 43 ~ 3/23/63 - 10/25/06 ~ Sent in by Karen ~ Walter was killed at Tilcon, Inc. in Wharton, NJ after being crushed by a machine. Walter J. Lubanty Jr, 43 was killed on the job on 10/25/06 while working at Tilcon, Inc in Wharton, NJ . He died from crushing injuries. Federal OSHA investigated the incident, and assessed a $12,500 penalty. The penalty was reduced to $7,500.

Travis Lee Lunn, 24

Travis Lee Lunn, 24 ~ 5/3/1984 - 9/12/2008 ~ Sent in by wife, Natasha Lunn ~ killed in a trench collapse while working at for John Prouty Construction Co.(Oneill), Verdel Nebraska.


Travis Lee Lunn, 24 was killed on the job on 09/12/08 while working at John Prouty Construction Co. in Verdel, Nebraska. He died from a trench collapse. Federal OSHA investigated the incident, and assessed a $201,600 penalty. The penalty was not reduced.

Stacy Lynn (Walls) McKinney, 27 ~ Sent in by sister, Christy Walls ~ FAUSTON BASSO SENTENCED TO 27 YEARS AND 8 MONTHS IN STATE PRISON -On July 20 2009, Tulare County Superior Court Judge Darryl Ferguson imposed a prison sentence of 27 years and 8 months in state prison on 39-year-old Fausto (Mike) Basso of Garden City, New York. On June 4, 2009 the defendant plead no contest to voluntary manslaughter, assault with a deadly weapon, and residential burglary. He admitted that he personally used a firearm during the crimes and that he inflicted great bodily injury.The defendant killed victim Stacey McKinney age 28 on July 13, 2006 in her home in Tulare. The defendant also inflicted serious injury on victim Andrew McKinney age 29, during the attack. All three crimes are violent felonies or strike offenses under the 'Three Striker' law. Furthermore, his credits are limited to 15% on the entire case. He was ordered to pay over $11,000 in restitution and over $1000 in fines. This case was prosecuted by Deputy District Attorney Afreen Kaelble, and investigated by Detective Todd Davis of the Tulare Police Department and Investigator Brain of the Tulare County District Attorney's Office Bureau of Investigations.

Brian P. Miller, 37

Brian P. Miller, 37 ~ 4/25/1972 - 10/21/2009 ~ Sent in by Sister, Keri Goff ~ He was working on a street sweeper for Hunter Maintenance and Leasing at the Elgin Sweeper Services facility in Chicago, Il when the hopper came down and crushed him. I miss my brother everyday, he was my only sibling and my rock.


OSHA investigated the incident, and assessed $4,200. The penalty was reduced to $3,500.

Charles Michael Morrison, 48

Charles Michael Morrison, 48 ~ 2005 ~ Sent in by Michelle Lewis ~ Killed at BandB Professional Pluming Inc in an unshored trench.


Charles Michael Morrison, 48 was killed on the job on 06/27/05 while working at B&B Professional Plumbing Inc in Pinellas Park, FL . He died in a trench collapse. Federal OSHA investigated the incident and assessed a $26,000 penalty. The penalty was reduced to $21,000.

David Morris Jr (Bud), 29

Leonard Maurice Moore, Jr. (Bozo Jr) ~ 9/3/2004 ~ Sent in by Katherine Rodriguez ~ Died at BP Texas City refinery from burns received from superheated water and stem. He died 22 hours later.

David Morris Jr (Bud), 29 ~ 12/30/2005 ~ Sent in by wife, Stella Morris ~ Killed at HandD Mining Inc/PP construction Inc/Black Mountain Resources LLC when struck in the head by coal hauler.


David "Bud" Morris Jr., 29 died on 12/30/2005 at the Black Mountain Resources H & D Mine #3 in Harlan County, KY. He was crushed by a piece of equipment. MSHA investigated and issued a $60,000 penalty. The company is delinquent in paying the fine; the mine is abandoned.

Alex Pacas, 19

Alex Pacas, 19 ~ Sent in by Aunt, Catherine Rylatt ~ engulfed by grain.


Alex Pacas, 19 was killed on the job on 07/28/2011 while working at Haasbach LLC, in Mount Carroll, Illinois when in engulfed by grain. OSHA investigated the incident and assessed a $555,000 the penalty was reduced to $200,000. There was and additional penalty from Wage and Hour of $68,235.

Bradley B. Pederson, 35 ~ 6/1/1975 - 6/22/2010 ~ Sent in by mother, Tess Pederson ~ My 35 yr old son Brad was killed 2 months ago in an truck rollover accident while on the job. He was hauling wood chips and debris cleanup from a logging project. He was a very wonderful man and loved his family and is so loved and admired and I really want to let others know. Dante M. Perales, 30

Dante M. Perales, 30 ~ 2/7/1975 - 2/5/2005 ~ Sent in by Mother Sister and Aunt ~ Killed in the line of duty. His name is Dante Perales and he is loved and missed more than words can ever say. Everyone seen the picture of him in his Police uniform but I wanted to show a different photo of him. I love you Dante and would do anything to have you back. Love Patricia.


Dante M. Perales, 30 was killed on the job on 2/5/2005 while working as a police officer in Orlando, FL. He died from a gunshot wound. His death was not investigated by OSHA.

Brian Steven Isdell, 55

Gary Puleio, 53 ~ 4/13/48 - 8/15/01 ~ Sent in by sister, Donna Puleio Spadaro, MD ~ Killed at Miadville Redi-Mix concrete from 25 ft. fall.

Gary Puleio, 53 was killed on the job on 08/15/01 while working at Meadville Redi-Mix concrete in Meadville, PA. He died from a fatal fall. Federal OSHA investigated the incident and assessed a $6,000 penalty which was not reduced.

Jimmy Lee, 33

Jimmy Lee, 33 ~ 5/20/2006 ~ Sent in by Melissa Lee ~ Killed in Darby Mine disaster.


Jimmy D. Lee, 33 died on 5/20/2006 at the Kentucky Darby coal mine in Harlan County, KY. He died following a methane gas explosion. MSHA investigated and assessed a $336,000 penalty. The company is delinquent in paying the fine; the mine is abandoned.

Juan Pablo Marillo, 30

Juan Pablo Morillo, 30 was killed on the job on 01/25/05 while working at Acetylene Service Company in Perth Amboy, NJ. He died from an acetylene explosion along with two other men. Federal OSHA investigated the incident and assessed $25,200. The penalty was not reduced.

Kevin Scott Noah, 42 was killed on the job on 08/13/02 while working at Himmick/Obayashi in San Francisco, CA. He died from a fatal fall. California OSHA investigated the incident and assessed a $26,025 penalty. The company contested and all violations and penalties were deleted.

 

Tommy Osier, 18 ~05/16/93 – 05/30/11~ sent by mother, Linda Osier ~ Today is the 3rd month without my “baby” boy. Tommy was entrapped in an old corn silo that a farmer had insisted in using for three years without a bottom feed unloader. Young men were required to climb in and shovel the corn down to an external auger to feed cattle. The “boys” 16-25 yr olds, took turns climbing in for 5-10 min at a time switching out when the gasses were to strong. Tommy had milked that morning leaving home at 3 am, since it was Memorial Day The farmer wasn’t going to work and Tommy’s replacement was a no-show. Tommy was told “stay and keep your job – Leave and don’t come back.” We had family birthday plans with Tommy since he had just turned 18, 14 days earlier. He was trying to get out as quickly as he could. The corn had created a cave, he hit the corn with the shovel and it came down on him funneling him to the bottom outlet 15 feet below, folding his body in half at the waist, entrapping his lifeless body in the small opening. I am convinced that the Lord swiftly released him from his earthly form. It took rescuers 5 hours to recover his body from the silo.

Pete, 37

Pete, 37 ~ My brother was just 37 years of age...he had a very full life but I am sure he was looking forward to enjoying much more of it for many years to come. Billy Price fell off room while working for subcontractor Tri-County Roofing, contractor Bryant Phillips Construction. Both companies were issued serious violations from OSHA for no safety equipment and proper training.


Billy Price, 41 was killed on the job on 5/21/2008 while working at Tri-County Roofing/Bryant Phillips Construction. Federal OSHA investigated the incident and assessed a $1,500 penalty. The penalty was not reduced.
